You must be at least 13 years old to use eluna, and where a higher minimum age applies under the law of your country or region, you must meet that higher age. By using the App, you represent and warrant that you meet these requirements and that you have the legal capacity to enter into these Terms. If you are using the App under the supervision of a parent or legal guardian, that adult accepts these Terms on your behalf and is responsible for your use.

eluna is an AI powered menstrual cycle companion that helps you log and understand your cycle, receive personalized insight, move in a way that suits your phase, reflect privately, connect through an optional community, and, if you choose, share cycle awareness with a partner. The App works without an account, while cloud sync, partner mode, community, and certain other features require you to sign in.

We are continually improving the App and may add, change, suspend, or remove features at any time. We may also impose limits on certain features or restrict access to parts or all of the Services without notice or liability.

You are solely responsible for any decisions you make based on the App, and you use it at your own risk.

The App includes AI powered insight and chat. AI responses are generated automatically and may be inaccurate, incomplete, or not suitable for your situation. AI features are provided for informational purposes only and are subject to the health disclaimer in Section 3. You should not rely on AI output as professional, medical, legal, or financial advice. We describe how AI requests are processed, and what data is and is not sent, in our Privacy Policy.

Some features require an account, which you can create with an email and password or through Apple Sign In. You are responsible for maintaining the confidentiality of your account credentials and any PIN you set, and for all activity that occurs under your account. You agree to provide accurate information and to keep it current. Notify us promptly of any unauthorized use of your account. You may delete your account at any time from within the App, as described in the Privacy Policy.

The core App is free to use. eluna+ is an optional paid subscription that unlocks additional features, such as deeper pattern insight and extended historical analysis. eluna+ is offered on iPhone and iPad. macOS features are provided free of charge.

Billing

eluna+ is available as an automatically renewing subscription (for example, monthly or yearly) or as a one time lifetime purchase. Prices are shown in the App before you buy and may vary by region and over time. All purchases are processed by Apple through the App Store, and are subject to Apple's terms. We do not receive or store your payment card details.

Automatic Renewal and Cancellation

An automatically renewing subscription renews at the end of each billing period at the then current price unless you cancel at least 24 hours before the end of the current period. Your Apple ID account is charged for renewal within 24 hours before the period ends. You can manage or cancel your subscription at any time in your device's App Store account settings. Removing the App does not cancel a subscription.

Refunds

Payments and refunds are handled by Apple and are subject to Apple's policies. Except where required by law, purchases are non refundable, and we do not control and cannot directly issue refunds for App Store transactions. To request a refund, contact Apple.

Free Trials and Offers

If a free trial or introductory offer is provided, any unused portion is forfeited when you purchase a subscription, where applicable. Details of any offer are shown at the time it is presented.

Partner mode lets you share selected cycle information with a person you invite. You control what is shared, and you may pause or revoke access at any time, as described in the Privacy Policy. You are responsible for choosing whom you invite and for what you choose to share. Do not invite anyone you do not trust with the information you enable. A partner who receives shared information must use it respectfully and only for the purpose of understanding and supporting you, and must not redistribute it.

The App offers an optional, sign in gated community where you can comment on shared threads, like, report, and block. Threads are generated by eluna, not by members. Content you create in the App, including community comments, notes, and journal entries, is "User Content".

Your Responsibility

You are solely responsible for your User Content and the consequences of posting it. You represent that you have the necessary rights to your User Content and that it does not violate these Terms or any law. Do not post anything to the community that you wish to keep private.

License

You retain ownership of your User Content. For User Content you post to the community, you grant us a worldwide, non exclusive, royalty free license to host, store, reproduce, display, and distribute that content solely to operate, moderate, and provide the Services. This license ends when you delete your User Content or your account, except to the extent the content has been shared with others who have not deleted it, or where we must retain it to comply with law. Journal entries and other content that stays on your device are not licensed to us, because they are not transmitted to us.

Moderation

Community comments are automatically reviewed before they are stored, and members can report or block others. We may, but are not obligated to, review, monitor, remove, or restrict any User Content or account at our discretion, including content that violates these Terms. You can report a comment or block a member from within the App, or email us at support@elunaapp.com. We review reports of objectionable content and act within 24 hours, including removing the content and, where warranted, suspending or removing the member responsible.

Copyright Complaints

We respect the intellectual property rights of others and expect you to do the same. If you believe that content in the community infringes a copyright or other right that you own or control, you may send a written notice to support@elunaapp.com with the subject line "Copyright Complaint". Please include a description of the work, a link to or description of the content you believe infringes it, your contact details, and a statement that you have a good faith belief that the use is not authorized. We will review valid notices, remove or disable infringing content where appropriate, and may remove members who repeatedly infringe.

Prohibited Conduct

You agree not to, and not to allow others to:

• Post content that is unlawful, harmful, harassing, abusive, hateful, defamatory, obscene, or that promotes self harm or violence
• Share medical misinformation presented as fact, or advice that could cause harm
• Impersonate any person or misrepresent your affiliation with anyone
• Post another person's private or identifying information without consent
• Post spam, advertising, solicitations, or content unrelated to the community's purpose
• Infringe the intellectual property or privacy rights of others
• Attempt to circumvent moderation, security, or access controls
• Reverse engineer, decompile, interfere with, overload, or disrupt the App or its infrastructure
• Use the App for any unlawful purpose or in violation of these Terms

We may remove content and suspend or terminate accounts that violate these rules, and we maintain a zero tolerance posture toward abusive or objectionable content and toward users who post it.

The App, including its software, design, text, graphics, logos, and the "eluna" name and brand, is owned by eluna and its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, non exclusive, non transferable, revocable license to use the App on Apple branded devices that you own or control, for your personal, non commercial use. You may not copy, modify, distribute, sell, or lease any part of the App, except as permitted by these Terms or applicable law.

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, store, and protect your information. By using the App, you consent to the practices described there.

The App relies on services provided by third parties, including Apple, Supabase, and our AI provider. Your use of those services may be subject to their own terms and policies, and we are not responsible for the acts or omissions of third parties. Availability of the App may depend on your device, operating system, and network connection, which are outside our control.

The App and the Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, to the fullest extent permitted by law. We disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, title, and non infringement. We do not warrant that the App will be uninterrupted, error free, secure, or free of harmful components, that predictions or insight will be accurate, or that the App will meet your requirements. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

To the fullest extent permitted by law, in no event will eluna or its owners, contributors, or suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of, or inability to use, the App, even if advised of the possibility of such damages. To the fullest extent permitted by law, our total aggregate liability for all claims relating to the App will not exceed the greater of the amount you paid to us, through Apple, for the App in the 12 months before the event giving rise to the claim, or ten United States dollars (US$10). Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you, and nothing in these Terms limits liability that cannot be limited under applicable law.

To the extent permitted by law, you agree to indemnify and hold harmless eluna and its owners and suppliers from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or connected with your User Content, your use of the App, your violation of these Terms, or your violation of any rights of another.

You may stop using the App at any time and may delete your account from within the App. We may suspend or terminate your access to the App or the Services at any time, with or without notice, if you violate these Terms or if we discontinue the Services. Upon termination, the licenses granted to you end, while provisions that by their nature should survive, including ownership, disclaimers, limitation of liability, and indemnification, will continue to apply.

We may update these Terms from time to time to reflect changes to the App, our practices, or the law. When we do, we will revise the "Last updated" date above, and for material changes we will provide a more prominent notice where appropriate. Your continued use of the App after an update takes effect constitutes acceptance of the revised Terms. If you do not agree to the changes, stop using the App.

These Terms, and any dispute or claim arising out of or in connection with them or their subject matter (including non contractual disputes or claims), are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia, without regard to its conflict of law provisions, and subject to any mandatory consumer protection laws of your country of residence that cannot be excluded by agreement. You agree to first try to resolve any dispute with us informally by contacting us at support@elunaapp.com. If a dispute cannot be resolved informally within 30 days, it will be subject to the exclusive jurisdiction of the courts of Jeddah, Saudi Arabia, except where applicable law grants you the right to bring proceedings in the courts of your place of residence.

The following additional terms apply because you obtain the App through the Apple App Store. You acknowledge and agree that:

• These Terms are between you and eluna only, and not with Apple. Apple is not responsible for the App or its content.
• The license granted to you is limited to a non transferable license to use the App on any Apple branded device that you own or control, as permitted by the Usage Rules in the Apple App Store Terms of Service.
• Apple has no obligation to furnish any maintenance or support services for the App. eluna is solely responsible for any product support and warranty (if any) as described in these Terms and to the extent required by law.
• In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the App to you; to the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the App.
• Apple is not responsible for addressing any claims by you or a third party relating to the App or your use of it, including product liability, failure to conform to legal or regulatory requirements, and consumer protection or privacy claims.
• In the event of any third party claim that the App or your use of it infringes that party's intellectual property rights, eluna, and not Apple, will be responsible for the investigation, defense, settlement, and discharge of such claim to the extent required by these Terms.
• You represent and warrant that you are not located in a country subject to a United States Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any United States Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you as a third party beneficiary.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and eluna regarding the App and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right or provision is not a waiver of that right. You may not assign these Terms without our consent, while we may assign them in connection with a merger, acquisition, or sale of assets.
