1. Eligibility

You must be at least 13 years old to use eluna. If you are under 18, you confirm that you have the consent of a parent or legal guardian. By using eluna, you represent that you meet these requirements.

2. Account

Some features require you to create an account using your email address or Apple Sign In. You are responsible for keeping your login credentials secure and for all activity that occurs under your account.

You agree to provide accurate information when creating your account. If you believe your account has been compromised, please contact us immediately at support@elunaapp.com.

3. What eluna Provides

eluna is an AI powered menstrual cycle tracking and wellness companion. The app provides:

• Cycle tracking with phase predictions
• Daily wellness logging (mood, energy, symptoms)
• AI generated insights personalized to your cycle phase
• An AI chat assistant for cycle related questions
• Partner mode for sharing selected cycle data with a connected partner
• Notifications for period, ovulation, and logging reminders
• Widgets for quick access to cycle information
• Data export in CSV format

4. Not Medical Advice

eluna is a wellness and informational tool. It is not a medical device, and nothing in the app should be treated as medical advice, diagnosis, or treatment.

AI generated insights are created automatically based on your logged data and cycle phase. They may not always be accurate and should not replace professional medical guidance.

Do not rely on eluna for contraception, fertility planning, or medical decisions. Always consult a qualified healthcare professional for medical concerns.

5. Subscriptions and Payments

Free Features

eluna offers core cycle tracking and daily logging at no cost.

eluna+ (Premium)

eluna+ is a paid subscription that unlocks additional features including personalized AI insights, AI chat, pattern detection, and partner mode. eluna+ is available as:

• Monthly subscription
• Yearly subscription
• Lifetime one time purchase

Billing

All payments are processed by Apple through the App Store. By subscribing, you agree to Apple's payment terms. Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date.

You can manage or cancel your subscription at any time through your Apple ID settings. We do not have access to your payment method or billing details.

Refunds

Since payments are handled by Apple, refund requests must be submitted through Apple. We do not process refunds directly.

6. Partner Mode

Partner mode allows you to share selected cycle information with one connected partner. By using partner mode, you acknowledge that:

• You are choosing to share certain personal health information with another person
• You control exactly what data is shared through permission settings
• You can revoke partner access at any time
• eluna is not responsible for how your partner uses the information you share with them

If you are the partner receiving data, you agree to respect the information shared with you and understand that it is personal health data shared in trust.

7. AI Features

eluna uses artificial intelligence to generate insights, daily guidance, and chat responses. By using these features, you acknowledge that:

• AI responses are generated automatically and may contain inaccuracies
• AI features are for informational and wellness purposes only
• Your messages and cycle data are processed through a secure proxy server to generate responses
• You should not share sensitive personal information (financial details, passwords, etc.) in the AI chat

8. Acceptable Use

You agree not to:

• Use eluna for any unlawful purpose
• Attempt to reverse engineer, decompile, or extract the source code of the app
• Interfere with or disrupt the app's servers or infrastructure
• Use automated systems or bots to access the app
• Share your account credentials with others
• Use partner mode to monitor someone without their knowledge or consent
• Submit abusive, harmful, or illegal content through the AI chat

9. Intellectual Property

All content, design, code, AI models, branding, and features within eluna are the property of eluna or its licensors and are protected by applicable intellectual property laws.

You are granted a limited, non exclusive, non transferable license to use the app for personal, non commercial purposes. This license does not give you ownership of any content or features within the app.

10. Your Data

Your use of eluna is also governed by our Privacy Policy, which explains how we collect, use, and store your information. By using eluna, you agree to the practices described in the Privacy Policy.

You retain ownership of the personal data you provide to eluna. You can export, delete, or manage your data at any time through the app.

11. Availability and Changes

We strive to keep eluna available and reliable, but we do not guarantee uninterrupted access. The app may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We reserve the right to modify, update, or discontinue features of the app at any time. If we make significant changes that affect your use, we will notify you through the app or by other reasonable means.

12. Limitation of Liability

To the fullest extent permitted by law, eluna and its team shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the app. This includes but is not limited to:

• Decisions made based on AI generated insights or cycle predictions
• Loss of data due to device failure, account deletion, or service interruption
• Actions taken by a connected partner based on shared cycle information
• Inaccuracies in cycle predictions, phase calculations, or AI responses

eluna is provided "as is" without warranties of any kind, whether express or implied.

13. Termination

You may stop using eluna at any time by deleting the app and, if applicable, deleting your account through the app settings.

We reserve the right to suspend or terminate your access to eluna if you violate these Terms or use the app in a way that could harm other users or our infrastructure.

14. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of eluna shall be resolved in accordance with those laws.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the app or by updating the date at the top of this document. Continued use of eluna after changes are posted constitutes your acceptance of the updated Terms.
